Piktostory is a product by Piktochart Sdn. Bhd. These Terms of Use relate to visitors to Piktostory’s website found on Piktochart.com/Piktostory and users of the Piktostory’s editor found on Story.Piktochart.com. This includes, you, dear reader. By visiting, remaining on this site, and using Piktostory’s editor, you agree to our Terms of Use and all applicable laws and regulations.
If you do not agree with any of these terms, please do not access this site or use the Piktostory’s editor. The materials contained on Piktostory’s website and its corresponding Piktostory’s editor are protected by applicable copyright and trademark laws.
Permission is granted to view and use the materials (information and software) found on Piktostory’s website (hereafter referred to as “Website”) and Piktostory’s editor (hereafter referred to as “Editor”). This permission of use does not allow you to:
Piktostory reserves the right to remove videos (projects, or clips) created using the Editor that are found to be in breach of the permissions of use above, or containing content that falls in any category below, with or without prior notice.
Such videos include content promoting any one or more of the following, but not limited to:
Piktostory reserves the right to remove your content (created videos, uploaded assets), with or without prior notice, at any time with immediate effect if you are found to violate any of these terms. Upon which, you should destroy any downloaded materials in your possession.
You are free to stop using the Editor and its functionalities (hereafter referred to as “Services”) at any time. We reserve the right to suspend or terminate your access to the Services with notice if you are using the Services in a manner that would cause a real risk of harm or loss to other users or us.
We will provide you with reasonable advance notice via your account’s email address to remedy the activity that prompted us to contact you. We may also give you the opportunity to export your created videos from our Services at our sole discretion. If you fail to take the steps we ask of you after such notice, we will terminate or suspend your access to the Services. Termination of access to the Services would also include all copies of your existing videos and/or uploaded assets to be removed, and they may no longer function as intended.
We will not provide notice before termination where:
(a) you are in breach of these Terms,
(b) doing so would cause us legal liability or compromise our ability to provide the Services to our other users, or
(c) we are prohibited from doing so by law.
All users retain the ownership and copyrights and intellectual property rights applicable to all materials uploaded to the Editor. This refers to videos in MP4 and MOV formats.
Users can freely distribute videos made using the Editor on any medium including TV, Internet and mobile.
Accounts created on the Editor belong to the person who owns the email address used to register the account. Parents of any student using the Editor can request for deleting student data in their account.The Metropolis font, used across the Website and the Editor as well as in the marketing and communication materials, is being used under the SIL open font license. Piktostory complies with the permissions and conditions associated with such use, such as are stated here.
Users retain the ownership and copyrights and intellectual property rights applicable to all materials (i.e. videos) uploaded to the Editor.
Further to that, you are responsible to not upload or publish any materials (data, videos, images and information) protected by copyright, trademark, or any other proprietary right without the expressed permission of the owner.
The holder of the account is solely liable for any damages resulting from copyright infringement, trademarks, proprietary rights, or any other harm resulting from created material. You agree to pay all royalties, fees, and any other monies owing any person for any materials posted by you via Piktostory.
While a subscription is not necessary to use the Editor, in order to get the most out of it, you are required to subscribe to either of the available plans. The subscription of which you are required to pay the applicable fees as described on Piktostory’s pricing page in order to access benefits in the Editor. The payments are made to our online reseller Paddle.com Market Limited (hereafter referred to as “Paddle”). Paddle is the Merchant of Record for all our orders.
By subscribing to one of the available plans, you agree to pay Piktochart Sdn. Bhd. through Paddle the subscription fees indicated for that plan. The fees described on Piktostory’s pricing page are exclusive of all taxes, levies, duties, or similar governmental assessments (collectively, “Taxes”) which are related to the sale. Paddle is responsible for the collection and remittance of the aforementioned Taxes.
All fees for recurring services are due before the beginning of the respective billing cycle. The billing cycle shall commence on the day you successfully start a subscription after paying the current fees, and end after one month (thirty days) for Monthly subscriptions, or one year (three hundred sixty five days) for Yearly subscriptions, and automatically renew with the same billing cycle.
Upon each successful payment, your account will be immediately activated with the benefits as per the subscribed plan. For certain benefits of the subscription plans where monthly quotas are made available, any unused quotas shall expire at the end of the billing cycle and cannot be transferred to the next billing cycle unless explicitly mentioned otherwise. New quotas will be added to your account according to the subscription plans as soon as the current fees has been paid for.
Should your account be in default, that is to say that we were unable to receive payment for a particular billing cycle’s renewal, we will attempt to retry the charges to the registered card of the current subscription plan. With continued failure to receive payment, Piktostory reserves the right to pause and/or cancel the current subscription, thereby reverting the account to a Free account as described in Piktostory’s pricing page.
You may cancel your current subscription at any time. No notice period is required and all future recurring payments will be halted. Upon cancellation, your account will still retain the benefits of the subscription plan up to the end of the current billing cycle that was paid for.
Requests for cancellation can be done on your account’s Settings page under the Subscription category on Piktostory, or you can contact us.
We also offer a 30-days money-back guarantee, which means we will refund you for any reason at all within 30 days from the payment date. Any other circumstances will be reviewed on a case by case basis. To request a refund, please contact us with the respective transaction receipt for us to process it effectively.
Avoid filing a chargeback through your bank separately or without going through us first so as to avoid any further unnecessary charges.
Use of information found on the Website and the use of the Editor is entirely at your own risk, for which Piktostory is not liable for. It is your responsibility to ensure that any products, services or information available through Piktostory meet your requirements.
You are responsible for compliance with any applicable local laws. Malaysia’s laws govern any claim relating to the Website and the Editor without regard to its conflict of law provisions.
Piktostory makes no guarantees, expressed or implied concerning the accuracy, likely results or reliability of the use of materials and information found on the Website, the Editor, or sites linked to Piktostory.
Piktostory does not endorse and has no control over user created videos. We cannot guarantee the authenticity of any data which users may publish on Piktostory.
Piktostory is not liable for any loss or damages suffered in connection with the use of or exposure to any content contained on the Website or any user created videos published, emailed, accessed, transmitted or otherwise made available via Piktostory.
In no event is Piktostory liable for any damages for loss of data, profit or business interruption arising out of the inability to use the materials on Piktostory including the Editor and all user created videos. You will be solely responsible for any damages or loss to any party resulting from it.
Piktostory accounts are designed to be used by a single user for each account created. Technical problems are likely to occur if more than one person uses an account at the same time. Therefore, we strongly recommend that you assign only one user per account to avoid complications that our support team may not be able to solve.
Information appearing on the Website and corresponding to the Editor could include technical, typographical or photographic errors. While we strive to do so, Piktostory does not guarantee that any of these materials are accurate, complete or current. Piktostory may make changes to the materials contained on the Website and the Editor without prior notice. But we do not make any commitment to update these materials indefinitely.
